At Bargainsandfun.com we have always errored on the side of caution when it came to possible issues with our site. We have always taken the customers word for this and in some cases it has bit us in the rump-roast. When we void an auction we inevitably have a user who won that auction - sometimes very cheaply - sometimes at a loss, but a winner non-the-less. In many cases everything is accepted by the winner as the auction being voided and all bids are refunded. In some cases however we have users who jump on us and tell us that the auction was only voided because it was a loss for the site.
We have updated the TOU of our site to include a section 13B. This section now requires that if you are going to report an issue to the site that you will have the burden of proof. Many of the issues that we regularly recieve complaints about can be easily confirmed or denied by a video recording. We further require that the user do a Trace-Route as part of the video immediatly following the event.
Any issues that are reported without proof will be reviewed on our end, if we can confirm the issue then we will take action. If we can not confirm that there was an issue, then unfortunantly there will be nothing that we can do.
